New RoHS and WEEE import controls on electrical and electronic equipment, applicable from January 16, 2023.

As of January 16, 2023, two new import inspections will be applied:

  • RoHS (Restriction of Hazardous Substances)
  • WEEE (Waste Electrical and Electronic Equipment)

The goods affected are electrical and electronic equipment (EEE), batteries, accumulators and battery packs (PPAA) included in Annexes I, II and III of Royal Decree 993/2022. The list of affected tariff items has been published by SOIVRE on the ESTACICE website.

The SOIVRE Inspection Service, in coordination with Customs, is responsible for controlling imports of goods subject to the new measures.

Checks prior to the release for free circulation of material from third countries shall verify that:

  • imports of electrical material, electronic material, batteries, accumulators and battery packs comply with the regulations that establish restrictions on the use of hazardous substances in the manufacture of these products.
  • those responsible for placing EEE and batteries, accumulators and battery packs on the EU market comply with the obligation to be registered in the Integrated Industrial Register (IIR) and with the environmental management of their waste.

The objective is that only products that comply with technical requirements that facilitate recycling and waste disposal processes, as well as the reduction of pollution and the prevention of environmental and health damage caused by restricted substances may be imported.

The controls will check whether imports of electrical material, electronic material, batteries, accumulators and battery packs comply with manufacturing standards.

To pass the control the manufacturer/importer must:

  • be registered in the Integrated Industrial Registry (RII).
  • attach the necessary technical documentation: Declaration of Conformity + Final Product Test Report or Third Party Production Certifications.

Goods that are subject to safety controls (Royal Decree 330/2008) and are also affected by RoHS/RAEE must apply through the ESTACICE website and obtain a certificate for the three measures (COM+RoHS+RAEE). The certificate model for product safety control products (Annex II Royal Decree 330/2008) has been replaced by the one included in Annex V of Royal Decree 993/2022.
